Preventing Discrimination – The Legal Framework
Under the Equality Act 2010, many neurodivergent conditions are classed as disabilities. Employers, therefore, have a duty to make reasonable adjustments to remove or reduce barriers that place neurodivergent individuals at a disadvantage.

Discrimination can occur both directly and indirectly. Indirect discrimination may arise where workplace practices, although neutral on the surface, disproportionately disadvantage neurodivergent employees. Examples might include timed recruitment assessments, noisy or overstimulating environments, or rigid attendance and communication policies.

To remain compliant and inclusive, employers should:

Provide clear, structured communication and expectations.
Offer flexibility in working patterns and environments.
Ensure line managers understand their responsibilities around reasonable adjustments.
Promote awareness and psychological safety across teams.
Beyond compliance, health and safety legislation also requires employers to protect both the physical and psychological well-being of their workforce. This includes proactively identifying and addressing risks that may uniquely affect neurodivergent employees, such as sensory overload, exclusionary communication, or inappropriate performance management processes.
